JUSTICE RAKESH KUMAR ORAL ORDER 19-09-2017 Heard Sri Krishna Kant Singh, learned counsel for the petitioners and , learned Addl. Public Proscutor. Two petitioners, who are in custody since 20.06.2017 in Kesariya P.S. Case No.167/2017 registered for the offence under Sections 272, 273, 290 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016 , have prayed for grant of bail.
It was submitted by learned counsel for the petitioners that huge quantity of Indian Make Foreign liquor was shown to be recovered from the Baithaka as well as from the vehicle standing outside the house of the petitioner and the petitioners have been arrested. It was submitted that the police after investigation has already submitted chargesheet and both
Patna High Court Cr.Misc. No.43495 of 2017(2) dt.19-09-2017 2/2 petitioners are having clean antecedent.
Considering the fact that after investigation, the police has already submitted chargesheet, as well as considering the nature of accusation, clean antecedent as well as period of custody, let both the petitioners, namely, (I) Vikas Kumar Sahani and (ii) Bablu Kumar Sahani @ Babloo Kumar Sahani be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Special Court of Excise, East Champaran at Motihari in connection with Kesariya P.S. Case No.167/2017.
