JUSTICE BIRENDRA KUMAR ORAL ORDER 10-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 498A, 494 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

Petitioner is the husband of opposite party no. 2. There is allegation of demand of dowry and torture for the same. Further allegation is that husband has already married with another lady.

Submission of the petitioner is that marriage with the opposite party no. 2 is itself denied, hence, there is no question of reconciliation.

Patna High Court Cr.Misc. No.22522 of 2016 (5) dt.10-03-2017 2/2 Considering the nature of allegation against the petitioner, I am not inclined to enlarge him on anticipatory bail in connection with Complaint Case No. 392C of 2015 pending in the Court of learned Sub-Divisional Judicial Magistrate, Khagaria. Hence, prayer for bail is refused.
