The petitioner, in the present case, is seeking regular bail in connection with Marahawrah P.S. Case No.163 of 2018, registered for offences alleged under Section 414/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner does not claim ownership of the stolen motorcycle as alleged in the First Information Report. He has been arrested in the present case when he was going on the motorcycle with the persons driving the same who had fled away on seeing the police party. It is further submitted that the petitioner has no criminal antecedent and is in custody since 19.04.2018.
Patna High Court Cr.Misc. No.37174 of 2018 (2) dt.29-06-2018 Learned APP for the State is present.
Considering the facts and circumstances whereunder the petitioner is not claiming ownership of the vehicle in question and that he has no criminal antecedent, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XIII, Saran in connection with Marahourah P.S. Case No. 163 of 2018, subject to the conditions U/S 437(3) Cr.P.C.
