JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Baribigha P.S. Case No.629 of 2017 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the instant case. He submits that only on the basis of suspicion the petitioner has been remanded in this case. Learned counsel submits that from perusal of the F.I.R., it would be evident that search and seizure was made on the basis of secret information received by the police that truck bearing registration no. JK 02A 0569 was used for transportation of liquor and the police saw that the truck was unloaded in the Khalihan of Uday Singh. He further submits that similarly circumstanced co-accused have been granted regular bail as well
Patna High Court Cr.Misc. No.40102 of 2018 (2) dt.10-07-2018 2/2 as anticipatory bail by different Co-ordinate Bench of this Court, which is evident from the report of the stamp reporter. The petitioner is in custody since 10.05.2018.
Considering the fact that other co-accused have been granted regular bail as well as anticipatory bail aforesaid, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional District & Sessions Judge, Sheikhpura in connection with Barbigha P.S. Case No.629 of 2017.
