Patna High Court CWJC No.7025 of 2020(2) dt.18-10-2022 2/3 encroachment on Aam Gairmajarua Land (Aam Public Land)" situated in villageKharka Tola, Chowa Bigha, PS-Makdumpur, Thana no. 254, Dist-Jehanabad bearing Plot no. 49 under Khata no. 136 area 22 decimals which stands recorded in Revisional Survey as Aam Gairmajarua land which is being used as public at large as passage pasture etc. since immemorial time but it a regrettable that the respondents no. 7 to 12 have illegally taken possession, constructed hut, house on a portion of the Aam land & thereby causing great inconvenience obstruction to the public despite the report of the respondent no. 6 who is Anchal Amin and measure the land and reported about the encroachment on the land made by the respondents no. 7 to 12.

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Jehanabad for redressal of his aforesaid grievance. Liberty so sought, is granted.

It is needless to state that in case, the petitioner approaches the Circle Officer, Jehanabad by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from

Patna High Court CWJC No.7025 of 2020(2) dt.18-10-2022 3/3 today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith.

The writ petition stands disposed off on the aforesaid terms.
