JUSTICE ARVIND SRIVASTAVA ORAL ORDER 17-07-2018 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of regular bail, arises out of Bhagalpur G.R.P.S. Police Station Case No. 250 of 2017, disclosing offences under Sections 401 of the Indian Penal Code and 25(1-B)A, 26(i)(35) of the Arms Act.
Learned counsel for the petitioners has submitted that the petitioners, who are of clean antecedent, are innocent and have not committed any offence. In fact, the petitioners happen to be vendors of the Railway and they are engaged in selling tea on the platform and due to non fulfillment of the illegal demand of the informant, these petitioners have falsely been implicated in
Patna High Court Cr.Misc. No.40546 of 2018 (2) dt.17-07-2018 this case and they are languishing in judicial custody for the last one year.
Considering the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Railway Court, Bhagalpur in connection with Bhagalpur G.R.P.S. Police Station Case No. 250 of 2017.
