The petitioner apprehends his arrest in a case under Section 394 of the Indian Penal Code.
The petitioner is not named in the F.I.R. Name of the petitioner figured in the confessional statement of a co-accused. The case is of highway robbery. In course of investigation, the witnesses disclosed the name of the petitioner. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in Sonbarsa P.S. Case No. 3/14. Accordingly, the same is rejected.
The petitioner, if so advised, may surrender in the court below within and make prayer for regular bail. The court below shall consider the prayer for regular bail of the petitioner without being prejudiced from this order and taking into
Patna High Court Cr.Misc. No.25663 of 2015 (2) dt.16-07-2015 2/2 consideration that other accused persons have been enlarged on regular bail.
