The petitioner seeks regular bail in Mithanpura P.S. Case No.95 of 2017 registered for the offence under Sections 302, 120(B) of the Indian Penal Code and Section 27 of the Arms Act. The petitioner is not named in the F.I.R.

Submission of the learned counsel for the petitioner is that except confessional statement of co-accused nothing has come against the petitioner. He is in custody for 3 1⁄2 months. He has clean antecedent. It is also submitted that the petitioner is brother of named accused Anjani Thakur and,as such, for putting pressure on Anjani Thakur to surrender he has been implicated in this case.

No.35195 of 2017 (2) dt.04-08-2017 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of learned S.D.J.M., East, Muzaffarpur, in Muzaffarpur P.S. Case No.95 of 2017, subject to the conditions that (i) one of the bailers of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) The petitioner will not induce any witness or tamper with the evidence. (iii) The petitioner shall cooperate in the disposal of the trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reason, his bail bond shall be cancelled.
