The petitioner seeks bail in connection with Muffasil P.S Case No. 312 of 2017 registered for the offences punishable under Section 302/34 of the Indian Penal Code. Allegedly, the father of the informant was found dead having injuries and it has been suspected that due to land dispute the petitioner and his four associates have killed the father of the informant.

Submission is of false implication and that besides suspicion there is nothing against the petitioner, the informant is not an eye-witness, the deceased was very old person, without any fault the petitioner is suffering in custody since 26.02.2018,

Patna High Court Cr.Misc. No.37010 of 2018(2) dt.28-06-2018 2/2 charge-sheet has already been submitted and there is no chance of tampering with the prosecution evidence.

Learned APP submits that the petitioner has got criminal antecedent.

In the facts and circumstances stated above, the petitioner is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger, in connection with Muffasil P.S. Case No. 312 of 2017, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
