This is an application for bail in connection with Naya Ram Nagar P.S. Case No. 136 of 2017 registered for the offences punishable under Sections 20 & 22 of N.D.P.S. Act. Allegation against the petitioner is of recovery of 1 kg and 200 gms of ganja from his possession.

Submission of learned counsel for the petitioner is that recovery has been made from 'Bhusha Ghar' and not from the possession of the petitioner and he is in custody for more than two months having no criminal antecedent.

Heard learned APP also, who has opposed the prayer for bail.

Having heard both sides and in view of facts and

Patna High Court Cr.Misc. No.40928 of 2017 (2) dt.06-09-2017 2/2 circumstances, I am not inclined to grant bail to the petitioner at this stage. Petitioner may renew his prayer for bail after framing of charge in this case or he completes six months period in judicial custody.
