JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Dumariyaghat P.S. Case No. 55 of 2018 for the offences under Sections 272, 273, 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. The petitioner is in custody since 28.03.2018. He submits that the petitioner has been made accused only on the basis of suspicion. Learned counsel submits that the petitioner is neither the owner of the tractor nor the driver of the tractor, on which the country made liquor was kept and seized by the police.
Considering the fact that the petitioner has remained
Patna High Court Cr.Misc. No.37261 of 2018 (2) dt.28-06-2018 2/2 in custody for three months and he has no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge- IV -cum- Special Judge, Excise, Motihari, East Champaran in connection with Dumariyaghat P.S. Case No. 55 of 2018.
