====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-04-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 329(3), 76, 303(2), 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita.

3. As per prosecution case, on 24.7.2024 at about 4 pm, when informant was cutting grass in her agricultural field, in the meantime, all the F.I.R. named accused persons including these petitioners reached there and petitioner No. 1 disrobed the informant and petitioner No. 2 grabbed her hair, tried to strangulate her and threw her on the ground. It is further alleged that the accused persons also snatched her gold and silver

4. Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case due to land dispute. Present case is counter blast of Supaul P. S. Case No. 442 of 2024 which was registered by the father of these petitioners against the husband of informant and others. Rest of the allegations are ornamental only to make the case grave.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of accusation and backdrop of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Supaul in connection with Supaul P. S. Case No. 531 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
