JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 07-06-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Bhagwanpur P.S. Case No. 01 of 2012 for the offence under Sections 395, 397, 412 of the Indian Penal Code and Sections 4/5 of the Explosive substance Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 06.07.2017 and as such he has completed nearly 11 months. He submits that similarly circumstanced co-accused, namely, Nandlal Sahni @ Nanda Sahni has been granted bail vide order dated 08.08.2012 in Cr. Misc. No. 28455 of 2012, Pathal Sahni has been granted bail vide order dated 26.11.2012 in Cr. Misc. No. 38049 of 2012 and Hari Gopal Rai has been granted bail vide order dated 10.10.2012 in Cr. Misc.

Considering the fact that that the similarly circumstanced co-accused have been granted bail and also the fact that petitioner has remained in custody for nearly 11 months, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XII, Vaishali at Hajipur in connection with Bhagwanpur P.S. case no. 01 of 2012.
