2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 6.3 litres of country made liquor has been recovered from the khalihan of the petitioner.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. He further submits that nothing has been recovered from the conscious possession of the petitioner and the place of recovery is an open place.

5. Learned APP for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances and the fact that petitioner has clean antecedent, nothing has been recovered from petitioner's conscious possession and the place of recovery is an open place, let the petitioner, above-named, in the event of his arrest / surrender before the learned trial Court within a period of eight weeks from today, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Court No. 1, Rohtas at Sasaram, in connection with Bikramganj P.S. Case No. 92 of 2025, subject to the condition as laid down under Section 438(2) of the Cr.P.C. / Section 482(2) of the BNSS, 2023.
