Having regard to the nature of allegation for offence under Sections 120B, 420, 467, 468 and 471 of the Indian Penal Code and that there is direct allegation against the petitioner that she had produced a forged certificate of her passing the Teachers Eligibility Test (T.E.T.), this Court would not be inclined to grant privilege of anticipatory bail to a person who seeks employment on the post of teacher by producing a forged certificate.

Such production of the T.E.T. was only going to give benefit to the petitioner and, therefore, the submission that the petitioner was yet to be appointed will make no impact so far the offence is concerned.

That being so, the prayer for anticipatory bail of the petitioner is hereby rejected but then nothing said in this order shall come in the way of the petitioner in surrendering and making prayer for

Patna High Court Cr.Misc. No.24615 of 2015 (3) dt.24-08-2015 2/2 regular bail. It also goes without saying that her prayer for regular bail shall be considered without being prejudiced of anything said in this order.
