JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-05-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 448, 341, 323, 354, 379, 504, 506/34 of the Indian Penal Code. The prosecution case is that on 01.08.2015 at 11 A.M. the accused persons entered the house of the informant and misbehaved with ladies members and snatched golden earring and chain and escaped from the scene.
It is submitted by the learned counsel for the petitioners that petitioners are neighbours of the informant and the petitioners' side at earlier point of time lodged Kahalgaon
Patna High Court Cr.Misc. No.20385 of 2016 (2) dt.11-05-2016 2/2 (Ghogha) P.S. case No. 311 of 2015 levelling accusation under sections 147, 149, 341, 323, 379, 427, 504, 506 of the IPC and under sections 3(1) (x) SC/ ST Act and thereafter the present case has been lodged. Statement has been in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri A Shamim, learned JM, Bhagalpur in connection with Kahalgaon (Ghogha) P.S. Case No. 312 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
