====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-06-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Excise Case No.841 of 2017, arising out of Barbigha (Mission O.P.) P.S. Case No.632 of 2017, registered under Section 30(a) of the Bihar Excise Prohibition Act, 2016. The allegation of the informant, who is the A.S.I. of Barbigha (Mission O.P.) Police Station, is that on 27.12.2017, illicit liquor was recovered from the house of Madan Sao and Suresh Singh regarding which Barbigha (Mission O.P.) P.S. Case Nos.630 of 2017 and 631 of 2017 were instituted on 27.12.2017 and, on query, they disclosed the name of Arun Ram and Bhola Ram and also disclosed about keeping of the illicit

Thereafter, the joint house of the aforesaid persons was searched from where in huge quantity, Indian Made Foreign Liquor was recovered. The informant claimed that Arun Ram, Bhola Ram, Pramod alias Chunni, Ravi Kumar (petitioner), Durga Rajak alias Tutu, Lallan Malakar, Vijay Malakar, Barkul Mahuri, Sintu Kumar, Madan Sao, Suresh Singh and Vikash Kumar used to run the business of illicit liquor.

Learned counsel for the petitioner submits that nothing was recovered from the possession of the petitioner. The informant only claimed about the involvement of the petitioner in running the business of illicit liquor. Further submission is that the petitioner has also been made accused in two other cases, as detailed in paragraph-3 to this application, for the same occurrence on 27.12.2017.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Sheikhpura, in connection with Excise Case No.841 of 2017,
