The petitioner apprehends his arrest in connection with Complaint Case no. 930©/2012 for the offences punishable under Sections 406 and 420 of the Indian Penal Code. The complainant made allegation that the petitioner took Rs.42,000/- from him on the pretext that such investment would earn more interest but the petitioner did not return the same. Learned counsel for the petitioner submits that there is no chit of paper to show that the petitioner took the money from the complainant.

On the other hand, learned counsel for the complainant submits that the petitioner had taken the money.

No.32791 of 2014 (2) dt.02-02-2015 2/2 Considering the fact that there is no chit of paper to show that the petitioner had ever taken the money from the complainant, let the above named petitioner, in the event of his arrest/surrender in the court below, within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Buxar, Complaint Case No. 930 © of 2012, subject to the conditions as laid down u/s 438(2) Cr.P.C.
