Petitioner is in custody in connection with Bhagwanpur Hat P.S. Case No. 35 of 2018 for the offence under sections 272, 273, 308 and 420 of the Indian Penal Code read with Section 30(a)/41(i) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he has remained in custody since 25.2.2018.

Considering the fact that petitioner has no criminal antecedent and he has remained in custody for more than three months, the court presumed that in the instant case charge-sheet

Patna High Court Cr.Misc. No.32623 of 2018(2) dt.06-06-2018 2/2 has already been submitted.

In view of the above, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge, Excise, Siwan, in connection with Bhagwanpur Hat P.S. Case No. 35 of 2018.
