Petitioner apprehends his arrest in a case under Section 307 and other sections of the Indian Penal Code. Petitioner is the order-giver and, on his order, Ajay Sah assaulted the informant Janardan Mishra. It is submitted that the police submitted final form finding the case false against the petitioner but the learned Chief Judicial Magistrate took cognizance on 13.08.2014. The assailant has already been granted bail by the learned Additional Sessions Judge and one of the coaccused, namely, Sudhir Sah has been granted anticipatory bail vide order passed in Cr. Misc. No.33393/2013. Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt
Patna High Court Cr.Misc. No.25655 of 2015 (2) dt.16-07-2015 2/2 / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in Majhaulia P.S. Case No. 427/2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
