The petitioner apprehends his arrest in a case under Section 409 of the Indian Penal Code.

The petitioner was granted anticipatory bail vide order dated 29.07.2015 passed in Cr. Misc. No. 2792 of 2015 on her undertaking that she would deposit the entire amount of Rs. 2,80,000/-, alleged to be defalcated by the petitioner, but she did not deposit the amount and filed a petition for modification of the order dated 29.07.2015 but the same was dismissed vide order dated 18.12.2015 on the ground that petitioner was not in a position to deposit the entire amount.

Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.18747 of 2016 (3) dt.17-05-2016 2/2 petitioner is ready to deposit the entire amount within two weeks. If the petitioner deposits the entire amount within two weeks through bank draft in the Government treasury and surrenders in the court below, i.e., learned Chief Judicial Magistrate, East Champaran at Motihari in Kalyanpur P.S. case No. 87 of 2014, learned court below shall consider the regular bail of the petitioner taking into consideration that the petitioner has already deposited the entire defalcated amount and dispose of the bail petition, preferably, on the same day.

Accordingly, this anticipatory bail petition is disposed of.
