JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under section 366A of the Indian Penal Code.

The accusation is of kidnapping the informant and establishing forceful physical relationship.

It is submitted by learned counsel for the petitioner that in 164 Cr.P.C. statement the victim got her age recorded as 15 years when the court also assessed her as 15 years but the victim on her returning of her own lodged the present case where she stated that she was kidnapped and ravished.

Aforesaid facts can be considered by the learned court

Patna High Court Cr.Misc. No.31903 of 2014 (2) dt.03-02-2015 2/2 below while considering the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Haspura P.S. Case No. 131 of 2013 pending in the court of learned J.M. Ist Class, Daudnagar. This application is disposed of with the aforesaid observation/direction.
