ANJANA MISHRA ORAL ORDER 21-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in compliant Case No.954C/2002 for the offence under Section 365 of the I.P.C.
On perusal of the impugned order passed by the learned District and Sessions Judge, Begusarai, it appears that the petitioner had been an absconder since 29.9.2005 and, as such, vide order dated 12.1.2006 he had been declared absconder. Considering the fact as recorded in the impugned order I am not inclined to grant anticipatory bail to the petitioner.As such, the same is rejected.
However, if the petitioner surrenders within two
Patna High Court Cr.Misc. No.32454 of 2014 (2) dt.21-01-2015 2/2 weeks from today, it would be open to the concerned court below to consider his prayer for bail on its own merit without being prejudiced by this order.
