2. In this case, the petitioner is seeking regular bail in connection with Balia Belon P.S. Case No. 80 of 2023, registered for the offences punishable under Sections 363, 366A, 376 of the IPC and section 4 of POCSO Act.

3. As per allegation, the daughter of the informant went missing. The informant along with his family members started searching for her and came to know that the petitioner took away his daughter on motorcycle.

4. The learned senior counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He is a person of clean antecedent. As a matter of fact, there was love and affection between the petitioner and the victim. The victim, as per her own sweet will, went with

Patna High Court CR. MISC. No.18475 of 2024(3) dt.14-08-2024 2/2 the petitioner, but under pressure and duress of her family members, she supported the prosecution case under Section 164 of the Cr.P.C. The petitioner is under custody since 20.06.2023 and the trial is proceeding at a snail pace.

5. On the other hand, the learned APP for the State Sri Shailendra Kumar has opposed the prayer for bail and submitted that the victim supported the prosecution case under Section 164 of the Cr.P.C.

6. Considering the above-mentioned facts and circumstances as well as period of custody which is more than a year and the fact that the trial is proceeding at a snail pace, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.D.J.-VII-cum-Spl. Judge, POCSO Court, Katihar in connection with G.R. No. 3610 of 2023, Balia Belon (Balia Belone) P.S. Case No. 80 of 2023, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
