====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR SINHA ORAL ORDER 15-06-2026 Heard learned counsel for the petitioner, learned counsel appearing for the respondent-State and learned counsel appearing for the Bihar School Examination Board.

2. With the consent of both the parties, this writ application is being disposed of at this stage itself.

3. In the present writ application, the petitioner has prayed for the grant of following reliefs:

"(a) For issuance of a writ of Mandamus or any other appropriate writ/writs, order/orders,

2/4 or direction/directions to Commanding the Respondent Board to consider the objection of the Petitioner with respect to Q. No. 58 having Question ID 4335763040 of the Secondary Teacher Eligibility Test (STET)- 2025 conducted by Bihar School Examination Board (BSEB) in Shift II on 15/10/2025.

Further for a direction to re-consider the Answer of Q. No. 9 having Question ID 4335763147 provided in the Revised Answer Key as it is incorrect and initially in the Provisional Answer Key it was correct.

(b) For quashing and setting aside the Result/ Score Card of the Petitioner as contained in Annexure- P/6 published by the Respondent Board and further be pleased to direct Respondent Board to publish a fresh Result/ Score Card of the Petitioner after re-considering the Answers provided in the Revised Answer Key with respect to Q. No. 58 having Question ID 4335763040 and Q. No. 9 having Question ID 4335763147.

(c) For any other order/orders in shape of consequential relief for which Petitioner may be found legally entitled to in the facts and circumstances of the instant case."

After advancing some argument, learned counsel for the petitioner submits that for seeking the aforesaid reliefs, the petitioner is prepared to file a fresh representation before the respondent no. 5, i.e., the Controller of Examination, Bihar School Examination Board, Patna, Bihar and prays that an appropriate direction be issued to the the Controller of Examination, Bihar School Examination Board, Patna, Bihar to dispose of his representation within a fixed time frame, after

3/4 giving an opportunity of hearing to the petitioner.

5. To the aforesaid submission being made by learned counsel for the petitioner, learned counsel appearing for the Bihar School Examination Board and learned counsel appearing for the respondent-State do not have any objection.

6. Considering the limited nature of prayer being made by learned counsel for the petitioner, this writ application is disposed of granting liberty to the petitioner to file a fresh representation before the Controller of Examination, Bihar School Examination Board, Patna, Bihar within one week from today and if such a representation is filed within the stipulated time, the Controller of Examination, Bihar School Examination Board, Patna, Bihar shall dispose of the same within one month from the date of receipt of the representation, after giving an opportunity of hearing to the petitioner.

7. Needless to emphasize that the final order which shall be passed by the Controller of Examination, Bihar School Examination Board, Patna, Bihar should be a reasoned and speaking order. In case, the petitioner is found entitled to the relief which the petitioner would be claiming through the representation, the same should be extended to the petitioner within a further period of one month from the date of passing of

8. With the aforesaid observation/direction and liberty granted, this writ application is disposed of. All pending interlocutory application(s), if any, shall also be deemed to have been disposed of.
