The petitioner has preferred this application for grant of regular bail in a case registered under sections 414, 379, 401 and 34 of the Indian Penal Code.

As per the prosecution case, on raid being conducted in the house of the petitioner, it is stated that a mobile phone was found for which the petitioner did not have any documents. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession or his house. He has been falsely implicated in the case. He is in custody since 17.12.2020 and has no criminal antecedent.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.26646 of 2021(2) dt.29-11-2021 2/2 taking into consideration the facts of the case together with the petitioner having remained in custody for over 11 months, the petitioner is directed to be enlarged on bail in connection with Araria P.S. Case no. 1034 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria.
