Petitioner apprehends arrest in a case registered for the offences punishable under Sections 20(b) (ii) (B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 As per prosecution case, 1.162 kg Ganja was recovered co-accused, namely, Raj Singh @ Raj Ranjan. Learned counsel appearing for the petitioner submits that name of the petitioner transpired on the basis on confessional statement of co-accused, namely, Raj Singh @ Raj Ranjan. No incriminating article has been recovered from possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner has got clean antecedent. Considering the facts and circumstances of the case,

Patna High Court CR. MISC. No.16610 of 2023(2) dt.19-05-2023 2/2 this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of District and Sessions Judge, Bhojpur at Ara in connection with Barhara (Krishnagarh O.P.) P. S. Case No. 741 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
