JUSTICE RAKESH KUMAR ORAL ORDER 01-11-2017 Heard Sri Sandeep Kumar, learned counsel, assisted by Sri Kumar Samarjeet Singh, learned counsel for the petitioner and Sri Nawal Kishore Prasad, learned Addl. Public Prosecutor. This is second attempt for grant of bail on behalf of the petitioner, who is in custody in connection with Maker P.S. Case No.50 of 2016 registered for the offence under Sections 386, 387, 399, 402, 120(B) of the Indian Penal Code, Sections 25(1b)a, 26,35 of the Arms Act, sections 4 & 5 of the Explosive Substance Act and Sections 16(1)B, 17,18, 18(A), 19, 20,38,39,40 of Unlawful Activities (Prevention) Act. Sri Sandeep Kumar, learned counsel for the petitioner submits that the petitioner is aged about 65 years and even during trial one of the main witness has turned hostile and, as
Patna High Court Cr.Misc. No.48076 of 2017(2) dt.01-11-2017 2/2 such, he has prayed for allowing the petitioner to be released on bail.
Earlier, the prayer for bail of the petitioner was rejected on 22.10.2016 vide Cr.Misc.No.40876 of 2016. Earlier before passing the order on bail petition, this Court had examined entire material including the case diary and considering the seriousness of the accusation, the prayer for bail of the petitioner was rejected.
Accordingly, there is no reason to review of my earlier. The prayer for bail of the petitioner stands again rejected. (Rakesh Kumar, J) nawalkrs/- U T
