JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 13-03-2019 Heard learned counsel for the petitioners and learned learned Additional Public Prosecutor for the State. The petitioners are in custody in connection with Dawath P.S. Case No. 159 of 2018 for the offenses under Sections 429, 153A, 295A, 34 of the Indian Penal Code. Learned counsel for the petitioners submits that petitioner No. 1 driver and the petitioner no. 2 is labourer. They have no criminal antecedent. Referring to the prosecution case he submits that the vehicle was carrying bones of the animals. There is suspicion that petitioners are involved in illegal trade of animal flesh. Counsel submits that there is a factory in the name of Esmat Bones and Fertilizer of which authorized partner is

Patna High Court CR. MISC. No.15571 of 2019(2) dt.13-03-2019 2/2 Abdul Waris and Abdul Quddus. The bone was purchased from Smath Bones and Fertilizer for which purchase challan was issued. The truck ws loaded on the basis of valid challan and merely on suspicion the petitioners have been apprehended and rotting in jail custody since 17.11.2018.

Considering the fact that the petitioners have no criminal antecedent, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas in connection with Dawath P.S. Case No. 159 of 2018.
