====================================================== CORAM: HONOURABLE MR. JUSTICE HARISH KUMAR ORAL ORDER 12-06-2023 Heard Mr. Diwakar, learned counsel for the petitioner and learned APP for the State.
The Petitioner is apprehending his arrest in connection with Ara Town P.S. Case No.981 of 2022 registered for the offences punishable under Sections 341, 323, 326, 307, 504, 34 of the Indian Penal Code.
It is alleged that on 23.11.2022 in the morning when the informant along with his son went to open shop, in the meantime, petitioner along with co-accused Ganesh Keshri went to his shop and started snatching goods from the shop, when the same was protested, this petitioner took out his dagger and stabbed in the mouth of the informant due to which he sustained injury.

No.19324 of 2023(2) dt.12-06-2023 2/3 Learned counsel appearing on behalf of the petitioner submits that in fact no such occurrence has taken place and prior to the institution of this case, the mother of the petitioner had instituted Ara Town P.S. Case No. 980 of 2022, wherein she has specifically alleged that an amount of Rs.7,500/- was due with the informant and when she asked to return the same, the informant and his son started abusing her and threatened to kill and when Anil Kumar Keshri, uncle of the petitioner came in her rescue, the informant attacked him by means of a big needle (Sua). It is alleged that in the process of rescue, the informant of the present case also sustained needle injury in his cheek.
He next submits that though the injury sustained over the cheek of the informant of the present case is concerned, the same is found to be simple in nature as is evident from the Annexure-3 of the bail petition. He lastly submits that the petitioner is a businessman having fair antecedent, and he is giving undertaking that he will fully cooperate in investigation, and he will not indulge in such type of crime in the near further. On the other hand learned APP for the State vehemently opposes the bail application.
Regard being had to the submissions made on behalf of the parties and considering the statement of the mother of the

Case No. 980 of 2022, coupled with the fair antecedent of the petitioner, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Ara in connection with Ara Town P.S. Case No.981 of 2022, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
