====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 13-05-2025 Heard learned counsel for the petitioner as well as learned APP for the State.

2. In this case, the petitioner is seeking regular bail in connection with S.T. No. 247 of 2024 arising out of Gaighat P.S. Case No. 458 of 2023, registered for the offences punishable under Sections 363 and 365 of the IPC and later on, sections 302, 201, 120(B)/34 of the IPC was added.

3. The informant alleged in her fardbeyan that she was living in her Maika and her husband came there on 25.11.2023 at about 7:00 PM. It is further alleged that her husband went somewhere while talking on phone and he did not return.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.17137 of 2025(3) dt.13-05-2025 2/2 this case. Except confessional statement of the petitioner, there is nothing in the entire case diary. The petitioner is brother-inlaw of the deceased and all the family members of the maike of Manisha Kumari (wife of the deceased) have been made accused. It appears that except confessional statement of the petitioner there is nothing against him in the entire case diary.

5. On the other hand, learned APP for the State opposes the prayer for bail of the petitioner.

6. Considering the above-mentioned facts and circumstances, the petitioner, above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-VIII, Muzaffarpur in connection with S.T. No. 247 of 2024 arising out of Gaighat P.S. Case No. 458 of 2023, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
