JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-07-2015 Heard learned counsels for the petitioner and the State. The petitioner being ex-Mukhia is apprehending arrest in a case registered for the offences punishable under Sections 420 and 409/34 of the Indian Penal Code.

The accusation is of purchasing the solar lights between 2006 to 2013 from the agency other than BREDA or BELTRON. It is submitted by the learned counsel for the petitioner that the purchase was made with approval of AAm Sabha of Gram Panchayat and no letter was circulated to the petitioner's panchayat before the actual purchase for purchase of the solar lights from BREDA or BELTRON. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.27250 of 2015 (2) dt.22-07-2015 2/2 petitioner is no longer Panchayat Mukhia, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhojpur at Ara in connection with Udwantnagar P.S. Case No. 365 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
