The petitioner has preferred this application for grant of regular bail in a case registered under sections 395 and 397 of the Indian Penal Code.

As per the prosecution case, about 7 named accused persons entered the house of the informant and committed dacoity.

It is submitted by learned senior counsel appearing for the petitioner that the FIR was registered against unknown. The name of the petitioner transpired in the confessional statement of a co-accused made before police. Contrary to the allegation no incriminating article has been recovered from the petitioner's possession. The petitioner is in custody since

Patna High Court CR. MISC. No.26671 of 2021(3) dt.03-01-2022 2/2 15.6.2020 and charge sheet has been submitted in the case without putting the petitioner on T.I. Parade. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for 1 year 6 months, the Court directs the petitioner to be enlarged on bail in connection with Dighalbank P.S. Case no. 57 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj.
