ANJANA MISHRA ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Mufassil P.S. Case No.201 of 2012 registered under sections 406, 420 and 387 of the Indian Penal Code.
Learned counsel for the petitioner submits that there was dispute between the parties regarding payment of price of coal delivered to the brick kiln belonging to the petitioner. The informant is an agent of the coking coal company. He further submits that there was no such transaction between the parties and, in fact, the petitioner has been receiving coal from other sources and not from the informant. As such, there was no question of threatening the informant and the allegations made in the
Patna High Court Cr.Misc. No.30511 of 2015 (3) dt.16-10-2015 2/2 complaint petition, are wholly misconceived.
Considering the aforementioned facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond Rs.10000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Mufassil P.S. Case No.201 of 2012, subject to the conditions as laid down under section 438 (2) of the Code of Criminal Procedure.
