Noorsarai, District- Nalanda. .... .... Petitioner
Versus
The State of Bihar .... .... Opposite Party ====================================================== Appearance :
For the Petitioner/s : Mr. Satya Prakash For the Opposite Party/s : Mr. Rajesh Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2018 Earlier twice prayer for bail of the petitioner was rejected by this Court vide order dated 3.5.2017 passed in Cr.Misc.No. 17753 of 2017 and vide order dated 20.9.2017 passed in Cr.Misc.No. 44780 of 2017 with an observation to conclude the trial within a period of seven months.
Submission of learned counsel for the petitioner is that seven months has already expired and out of 13 witnesses only five have been examined and there is no likelihood to conclude the trial in near future.
Heard learned APP also, who has opposed the prayer for bail.
In such view of the facts and circumstance and also in view of direct allegation against the petitioner, I am not inclined to
Patna High Court Cr.Misc. No.32107 of 2018 (2) dt.21-06-2018 2/2 grant bail to the petitioner.
However, as the evidence has commenced, learned trial court is directed to expedite the same and try to conclude the trial as soon as possible.
With the above observation, this application is dismissed. (Vinod Kumar Sinha, J) spal/- U
