Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is apprehending his arrest in connection with Piro P.S. Case No. 44 of 2015 for the offences instituted under Sections 380, 448, 435, 436, 504 and 506/34 of the IPC. The prosecution story, in brief, is that the petitioner entered into the house of the informant in the night and committed theft of an attaché case containing ornaments and clothes and in order to scare away the inmates, put on fire the pipe of Gas Cylinder causing extensive loss to the house of the informant. The petitioner was helped by two other unknown persons.
Patna High Court Cr.Misc. No.20576 of 2016 (3) dt.27-06-2016 2/2 It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. The allegation made in the F.I.R., has been denied by the petitioner. From perusal of the supplementary affidavit, it is evident that an informatory petition was filed on behalf of the petitioner. From perusal of the informatory petition, it is evident that the petitioner and the daughter of the informant were having love affair which was objected by the informant. For the said reason the petitioner has falsely been implicated in the present case. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Piro P.S. Case No. 44/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Bhojpur at Ara, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
