The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016 and sections 26 and 35 of the Arms Act.
As per the prosecution case, secret information was received that illicit liquor was kept in the house of Prithvi Nath Singh and the same was being sold by Sonu Singh and Golu Singh. On a raid, 168.75 litres of IMFL was recovered besides 37 cartridges.
It is submitted by learned senior counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession. He has been falsely implicated in the
Patna High Court CR. MISC. No.27198 of 2021(2) dt.30-11-2021 2/2 case. The alleged recovery is from the house of Prithvi Nath Singh. He is in custody since 20.1.2021 and has no antecedent under the Bihar Prohibition and Excise Act, 2016. Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the facts of the case especially the petitioner not having any antecedent under the Bihar Prohibition and Excise Act, 2016, the Court directs the petitioner to be enlarged on bail in connection with Sahar P.S. Case no.297 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge IV-cumSpecial Judge, Excise, Bhojpur at Ara.
