Heard learned counsel for the petitioner and learned APP for the State.
The petitioner has preferred this application for grant of regular bail in a case registered under section 147, 148, 149, 384, 386, 302, 504, 341, 323 and 120(B) of the Indian Penal Code and 27 of the Arms Act.
The petitioner and other co-accused are said to have shot the husband of informant dead on account of ransom money.
Learned counsel for the petitioner has submitted that
Patna High Court CR. MISC. No.16385 of 2022(2) dt.20-07-2022 2/3 the petitioner is innocent and he has falsely been implicated in this case merely on the basis of suspicion. The petitioner is accused in two other criminal cases as stated at para 3 of the bail petition. There is general and omnibus allegation against the petitioner and the petitioner is in custody since 26.09.2021. There is no eye witness in this case. The deceased Raj Ballabh Kumar was a boat man and in this case altogether 76 persons and 20 unknown are made accused. There is no specific allegation against the petitioner.
Learned A.P.P. for the State has opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Danapur (Patna), in connection with Maner P.S. Case No. 752 of 2021, with a condition:-
1. The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
