JUSTICE GOPAL PRASAD ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 15-01-2015 The petitioner approached this Court by filing public interest litigation. He states that on the bank of Punpun river, at the outskirt of the Patna city, Pind-dans during Pitripaksha are conducted and it is a common centre at international level. According to him, huge number of persons gather at the relevant point of time, but the facilities are not adequate. It is stated that

Patna High Court CWJC No.13696 of 2014 (2) dt.15-01-2015 2/3 the District Magistrate, Patna has recently on 24.07.2014 accorded technical sanction for the project and submitted proposals to the State Government for release of the amount. His grievance is that no steps were taken thereafter. Heard Sri Suresh Prasad Singh, learned counsel for the petitioner and Smt. Namrata Mishra, learned Government Advocate for the respondents.

It is a rare facility or event that takes place on the bank of Punpun. It is rather interesting to note that the facility is recognized at international level. When such is the importance which the location has gained, it is in the fitness of the things that the State also makes adequate arrangements. As a matter of fact, providing facilities would bring revenue to the State also in the form of tourism, apart from providing livelihood to number of unemployed persons or business to establishments like hotels. The very fact that the District Magistrate addressed letter dated 24.07.2014 referring to the preparation of plans, the verification of the site and making of estimates, discloses the amount of interest he has evinced and the importance of the work. Though it is in the form of proposal to the Government, it needs attention of the Government without any further delay since the matter concerns a public importance

Patna High Court CWJC No.13696 of 2014 (2) dt.15-01-2015 3/3 We, therefore, dispose of the writ petition directing the respondents to take further steps in pursuance of the letter dated 24.07.2014 addressed by the District Magistrate and complete them by the time the event becomes due next. Interlocutory application, if any, shall stand disposed of. There shall be no order as to costs.
