JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 29-11-2021 Learned counsel for the petitioner submits that the order impugned dated 10.01.2020, passed by learned Principal Judge, Family Court, Lakhisarai in Maintenance Case No.21 of 2019 has been passed ex-parte and he has to file an application before the learned court below for recalling the said order under Section 162(2) Cr.P.C.

Having considered the facts aforesaid, this application is disposed of with a direction that if learned counsel for the petitioner files such an application before the learned court below recalling the order dated 10.01.2020, passed by learned Principal Judge, Family Court, Lakhisarai in Maintenance Case No.21 of 2019, the learned court below shall, after hearing both the sides, pass a speaking order in accordance with law.

Patna High Court CR. REV. No.315 of 2020(2) dt.29-11-2021 2/2 Limitation, if any, shall be condoned by the learned court below.
