JUSTICE ARVIND SRIVASTAVA ORAL ORDER 27-08-2020 At the outset, learned counsel appearing for the petitioner seeks permission to withdraw the application as against petitioner no. 2, namely, Bablu Kumar @ Babloo Sah. Permission is granted.

The application, thus, stands dismissed as withdrawn as against petitioner no. 2, Bablu Kumar @ Babloo Sah. Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner apprehends arrest in connection with Charpokhari P.S. Case No. 9 of 2020 registered for the offence under section 30(A) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case merely on

Patna High Court CR. MISC. No.16039 of 2020(3) dt.27-08-2020 2/2 basis of suspicion. Nothing has been recovered from the conscious possession of this petitioner. Petitioner has no criminal antecedent.

Having considered the above facts and circumstances of the case, let the petitioner no. 1, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing personal bond to the satisfaction of 4th Additional Sessions Judge-cum-Special Judge, Excise, Bhojpur at Ara in connection with Charpokhari P.S. Case No. 9 of 2020 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure..
