JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-05-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 34 of the Indian Penal Code.

The prosecution case is that on the basis of forged rent receipt the petitioner and one Rajesh Sah tried to take KCC loan.

It is submitted by learned counsel for the petitioner that admittedly no loan was sanctioned nor it was disbursed to the petitioner. A statement to that effect has been made in para 9 of the petition. The petitioner was himself a victim as someone has given him the alleged forged rent receipt. It is further submitted that co-accused Rajesh Sah has been granted anticipatory bail by a coordinate Bench of this Court vide Cr. Misc. No. 23141 of 2015.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

No.22888 of 2016 (2) dt.23-05-2016 2/2 Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Raxaul at Motihari in connection with Palanwa P.S. Case No. 7 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
