JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 21-05-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Sikta P.S. Case No. 112/2017 registered under Sections 304B, 201/34 of the Indian Penal Code.

As per the prosecution case, the petitioner along with his family members is said to have committed dowry death of the daughter of the informant and cremated the dead body. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. The petitioner happens to be father-in-law of the deceased. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The deceased died her natural death as she was

Patna High Court Cr.Misc. No.31345 of 2018 (2) dt.21-05-2018 2/2 suffering from liver problem. The informant had also participated in the cremation of the deceased. Though the occurrence is said to have taken place on 08.06.2017 but the written report has been filed after delay of 21 days without assigning any explanation for the said delay. The petitioner has been languishing in custody since 20.02.2018.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Bettiah, West Champaran in connection with Sikta P.S. Case No. 112/2017.
