====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 13-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Pandarak P.S. Case No. 91 of 2021 lodged under Sections 341, 323, 325, 307, 504, 506/34 and 379 of the Indian Penal Code. As per the prosecution, F.I.R. has been lodged against 8 known persons alleging therein that they all started abusing to the informant and assaulted by iron rod but as per F.I.R., the specific allegation against one Raju Kumar to attack by iron rod on the head and mouth, resulted into bleeding and informant became faint.
Learned counsel for the petitioner submits that from the F.I.R., itself it is crystal clear that allegation against the present petitioner is general and omnibous in nature. The
Patna High Court CR. MISC. No.18478 of 2022(2) dt.13-07-2022 2/2 specific allegation of attack is only Raju Kumar not against the present petitioner. He further submits that petitioner is in custody since 07.11.2021 and charge sheet has already been filed in this case.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-Ist., Barh, Patna in connection with Pandarak P.S. Case No. 91 of 2021, subject to the conditions as laid down under Section 437(3) of Criminal Procedure Code.
