The petitioner apprehends his arrest in Bakhtiyarpur P.S. Case No. 493/2015, registered for the offences punishable under Section 7 of Essential Commodities Act.

The police intercepted tractors laden with wheats on suspicion that the wheats are of F.C.I. godown , but the petitioner claimed the wheat to be purchased in open market and was being carried to the market.

It is submitted that other co-accused persons have already been granted anticipatory bail. Petitioner is not named in the F.I.R. He is a bona fide purchaser of the wheat who has come forward to claim the ownership of the seized wheat.

No.20752 of 2016 (2) dt.19-05-2016 2/2 Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Saharsa in connection with Bakhtiyarpur P.S. Case No. 493/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
