15-09-2017 Heard Sri Sanjay Kumar No. 7, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 22-07-2017 in Harsidhi P.S. Case No. 253 of 2017 registered for offence under Sections 272, 273 of the Indian Penal Code and Section 30(A) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner has been made accused on the basis of confession of one of the accused i.e. driver of a tractor, from which, 11 drum containing spirit was recovered. He submits that save and except confessional statement of the co-accused, there is no other material against the petitioner.

Considering the nature of accusation as well as period of
