Having been lodged in custody since 20.06.2017 in Motihari Town P.S. Case No. 438 of 2017 registered under sections 379 and 414, the petitioner prays for grant of bail. The petitioner was seen nearby the motorcycle and seeing the police tried to run away. On a chase, he was apprehended. He could not explain the ownership of the motorcycle. It is stated that although the police have framed him in several cases cited in para 3, but he has been released on bail as those were the cases lodged against unknown. Counsel for the State opposed the prayer referring to the statements made in paragraph 3.

No.50947 of 2017(2) dt.20-11-2017 2/2 In the circumstances, present application is disposed of by the following order:- After framing of charge against the petitioner in the present case if he furnishes the bail bonds in the sum of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned court below, the same shall be accepted and he shall be released on bail in Motihari Town P.S. Case No. 438 of 2017 on condition that one of the bailors shall be his own/close family member. Further the petitioner shall present himself on each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall cancel his bail bonds of secure his arrest in accordance with law.
