Petitioner is apprehending his arrest in connection with Ara Town P.S.Case No.149/2017 dated 19.3.2017 , registered for offences punishable under Sections 406, 420, 120(B)/34 of the Indian Penal Code.
Petitioner happens to be informant of this case and the allegation as per FIR is that the accused persons under a conspiracy got amount deposited in the D.J.N. Group of the Company and the informant has also deposited Rs.5,48,835/- but after collecting the amount, the office was closed and the accused persons fled away.
Submission of the learned counsel for the petitioner is that he has also deposited the amount, as such lodged this case
Patna High Court CR. MISC. No.15165 of 2019(5) dt.25-07-2019 2/2 but after investigation, he has been made accused stating that he along with the other accused persons under a conspiracy cheated the depositors. No specific allegation has been alleged against the petitioner as to whether he has received any amount of the deposits or he was any office bearer of that company.
Heard learned A.P.P. , who has opposed the prayer for bail, but not controverted the above facts. . Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Ara District Bhojpur in connection with Ara Town P.S.Case No.149 of 2017, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
