Lodged in jail custody in connection with Dalsingsarai P.S. Case No. 255 of 2016 registered under sections 414 and 401 IPC, the petitioner has prayed for grant of bail. The petitioner was found on motor-cycle which was chased. He fell down with the motor-cycle. The allegation is that he did not produce papers of the vehicle. It is submitted that the petitioner has no criminal antecedents. He is in custody since 11.07.2016. Referring to the impugned order, it is submitted that the charges have already been framed by the trial court.

Considering the period of incarceration and the other materials reflecting from the records, the petitioner is directed

Patna High Court Cr.Misc. No.47372 of 2017(2) dt.13-10-2017 2/2 to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Samastipur in Dalsingsarai P.S. Case No. 255 of 2016 on condition that one of the bailors shall be his own/close family member. He shall appear in person before the court concerned on each date fixed in trial. In case of default in such appearance on two consecutive dates, the trial court shall cancel his bail bonds and secure his arrest in accordance with law.
