JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 8/20(b) (ii)(B)of the NDPS Act.

As per the prosecution case, 6.930 Kg of Ganja has been recovered from the house of co-accused, Amit Kumar Sharma.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case only because he is brother of co-accused, Amit Kumar Sharma from whose house alleged Ganja has been recovered. No incriminating article has been recovered from the conscious possession or premises of the petitioner and he is no way concerned with the alleged recovery. Petitioner has got
